Terms of Service

These are a starting draft, not legal advice. Every bracketed item below has to be filled in, and the whole document reviewed by a lawyer in your jurisdiction, before it is published. Publishing it asks every user to agree to it and blocks the app until they do.

1. Who we are

Spark ("the app") is operated by [COMPANY LEGAL NAME], registered at [REGISTERED ADDRESS], [COUNTRY] (“we”, “us”). You can reach us at [CONTACT EMAIL].

2. Agreeing to these terms

By creating an account or using the app you agree to these terms. If you do not agree, do not use the app. We ask you to accept a new version when we publish one; until you do, you will not be able to use the app.

3. Who may use Spark

You must be at least [MINIMUM AGE] years old to have an account. If you are under the age of majority where you live, you may only use Spark with the consent of a parent or guardian, who accepts these terms on your behalf.

One account belongs to one person. Do not share your password, and tell us promptly if you believe someone else has used your account.

4. Your content

You keep ownership of the decks, cards, notes and images you create. By putting content into Spark you give us the licence we need to store it, back it up, show it back to you and — only if you publish or share it — show it to the people you have shared it with. We do not claim ownership of it and we do not sell it.

You are responsible for what you upload. Do not upload content you have no right to use, content that infringes someone's copyright, or content that is unlawful, abusive or designed to harm others.

5. AI-generated content

Spark can generate cards, explanations and images with AI. What it produces is not guaranteed to be accurate and must not be relied on as professional advice — medical, legal, financial or otherwise. Check anything that matters.

Generated content is produced by third-party AI providers on our behalf. What you send to be generated from is sent to them for that purpose. See the Privacy Policy for who they are.

6. Stars, purchases and subscriptions

Stars are an in-app balance used to acquire content and run certain features. Stars have no cash value, cannot be exchanged for money, and are not transferable between accounts.

Paid plans and Star packs are sold through the app store you installed Spark from, and their refund rules apply. We may change prices; a change never affects a period you have already paid for.

Free Stars — daily grants, streaks, rewarded ads, referrals — are a promotion, not a purchase, and we may change or end them.

7. Acceptable use

Do not: break the law with Spark; attempt to access another person's account; scrape, resell or systematically copy the catalogue; interfere with the service or its security; use it to harass anyone; or automate access in a way that places an unreasonable load on the service.

We may suspend or close an account that does these things. Where we can, we will tell you why first.

8. Availability

We work to keep Spark available and correct, but we do not promise it will be uninterrupted or error-free. We may change features, and may withdraw ones that are not working, with notice where it matters.

9. Ending it

You can delete your account at any time from Privacy & Security in the app. The account is suspended immediately and permanently erased after the grace period shown to you at the time — [GRACE PERIOD] days as of this version. Signing in again before then cancels the deletion.

We may close an account that seriously or repeatedly breaks these terms. If we do, we will tell you at the email address on the account.

10. Liability

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you is limited to [LIABILITY CAP], and we are not liable for lost profits, lost data beyond our backup obligations, or indirect loss.

11. Changes to these terms

We will publish a new version when these change and ask you to accept it. The version you accepted, and the date you accepted it, are recorded on your account.

12. Governing law

These terms are governed by the laws of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction, except where the law of your country of residence gives you rights that cannot be overridden.
